1. Service Description

ELYVN is an AI-powered receptionist platform that answers phone calls, qualifies leads, sends SMS follow-ups, and books appointments on behalf of your business. By using ELYVN, you agree to these terms.

2. Account Responsibilities

• You are responsible for providing accurate business information during setup
• You are responsible for maintaining the security of your account credentials
• You must ensure you have the right to use any phone numbers connected to ELYVN
• You are responsible for the accuracy of your AI agent's knowledge base

3. Acceptable Use

You agree not to use ELYVN to:

• Send spam or unsolicited bulk messages
• Engage in any illegal activity
• Harass, threaten, or deceive any person
• Violate any applicable telecommunications regulations
• Misrepresent the AI as a human when legally required to disclose

Violation of these terms may result in immediate account suspension.

4. Payment Terms

• Billing is processed through Stripe on a monthly cycle
• Plan tiers (Starter, Pro, Premium) are billed at the rates listed on our pricing page
• You may upgrade or downgrade your plan at any time; changes take effect at the next billing cycle
• Refunds are not provided for partial months
• We reserve the right to adjust pricing with 30 days written notice

5. Service Availability

ELYVN is provided on a best-effort basis. We strive for high availability but do not guarantee uninterrupted service. We are not liable for missed calls, failed messages, or booking errors caused by service outages, third-party provider issues, or force majeure events.

6. Limitation of Liability

To the maximum extent permitted by law, ELYVN and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, lost profits, or loss of business opportunity arising from your use of the service. Our total liability shall not exceed the amount you paid to ELYVN in the 12 months preceding the claim.

7. Termination

• You may cancel your account at any time with no penalty
• We may suspend or terminate your account for violation of these terms
• Upon termination, your data will be retained per our privacy policy retention schedule, then deleted

8. Changes to Terms

We may update these terms from time to time. Material changes will be communicated via email or Telegram notification at least 14 days before taking effect.
